We tried a murder case in Ulster County NY last May. We waived a jury and tried the case before a judge who acquitted our client of murder but convicted him of the lesser included count of manslaughter. We filed a post-verdict motion to vacate the conviction based on alleged judicial and attorney ethical violations. A newly assigned judge handed down a decision ordering a full evidentiary hearing on the serious allegations. Law360 published an article on the judge’s decision. We expect the hearing to be concluded in May.
